FBT Bank and Mortgage Terms of Use

Internet or Mobile Banking Terms of Use

As a feature of your FBT Bank and Mortgage Account(s), FBT Bank and Mortgage offers an Online or Mobile Banking Service, which provides Internet or Mobile access to your Account(s).  This Agreement governs your use of the Services provided by FBT Bank and entities that support FBT Online or Mobile banking services. This agreement also defines your rights and responsibilities under all governed laws. PLEASE READ THE AGREEMENT CAREFULLY BEFORE ENROLLING IN THE SERVICES OR INITIATING ANY TRANSACTIONS. PLEASE KEEP A COPY OF THE AGREEMENT FOR YOUR RECORDS. BY UTILIZING THE ONLINE OR MOBILE BANKING SERVICE, YOU HAVE AGREED TO COMPLY WITH AND BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT.

Mobile or Online Services may be used for:

  • Access to your account balances and review transactions. You can review transaction detail and history for up to 6 months.
  • Transfer funds between approved FBT accounts
  • Transfer money utilizing Person to Person to approved US Debit Cards
  • Make FBT loan payments utilizing the FBT transfer option or Make a Payment option. “FBT transfer option is an internal option with no fees associated.”  “Make a payment option is handled by a third party processor allowing you to use a credit card for payments.  The Make a Payment option has associated fees.”
  • Bill Pay for one time or recurring payments
  • Access E-Statements
  • Check Reordering
  • Financial information downloads for approved accounting software
  • Mobile deposits. “Mobile App Only”
  • Card Management allowing turn on and off
  • Managed Alerts
  • FBT Bank Messages
  • Contacting FBT Bank and Mortgage
  • Gather information about FBT Bank and Mortgages available services
  • Budgeting Tools and Finance Calculators. “This is provided by a third party.”

Fees

All services listed above are free for any account user unless noted above that charges apply.

Transfer and Bill Pay Limitations

Overdraft and/or NSF charges may be incurred if the payments and/or transfers exceed your account balance. FBT Bank and Mortgage is not responsible for rejecting transfers and bill payments that exceed your account balance.

Payments

P2P, Bill Pay, Transfers, or Credit Card transactions that have been completed or in process cannot be reversed.  If you have questions prior to completing a payment feel free to contact FBT Bank and Mortgage at 870-352-3107.  Credit Card payments will have an associated fee % that will be present on the pay portal.  Both Bill Pay and Credit Card payments are hosted by a third-party

Signature Requirements

You agree that by authorizing a transfer and/or payment using the Mobile or Online Services that FBT Bank and Mortgage can debit the account without a signature and without notice to you. Please note, if your account contains a dual signature check requirement, that the dual signatures do not apply to transfers and/or bill payments initiated through the Mobile or Online Services. Users on accounts that require dual signature checks MUST be authorized individually to make electronic transfers and bill payments through the Mobile and Online Service.

User Credentials

You agree to protect your user credentials by not providing username, password, or pin information to any person or request.  You agree to assume responsibility for all transactions initiated through the Service with your User Name and Password, up to the limits allowed by applicable law.  You agree to contact FBT Bank and Mortgage immediately if you believe your user credentials have been compromised.  You agree to consider password changes every 90 days.

Communications

You agree to communicate with FBT Bank and Mortgage in a secure fashion.  You agree to refrain from sending confidential information via email, text, video, or any other media that would put customer information in danger.  Encrypted services should be utilized when sending confidential information via email.  All transmission to FBT Banks Mobile App or Website will remain the property of and shall be free to use by FBT Bank and Mortgage.

Electronic Mail

FBT Bank and Mortgage will respond to electronic mail messages within 24 hours during standard operating hours. FBT Bank and Mortgage will respond to Electronic mail messages sent on weekends within 24 hours of the first standard operating hours.  It is recommended that requests related to transfers, stop payments, fraudulent activity, or any urgent message be relayed directly to our FBT Staff.  Contact information can be found on the About page.

 

Hours of Operation

FBT Bank and Mortgage will make all efforts to ensure the Mobile and Internet Banking services are available 24 hours a day, seven days a week, except during special maintenance periods, or outages.   FBT Bank and Mortgages physical business hours can be located on the “Locations and Hours” Page.

Changes and Hardware compatibility

FBT Bank and Mortgage reserves the right to modify or change the website or mobile app at any time and without notice.  You are responsible for reviewing the terms and conditions on a regular basis to ensure you are in compliance with the terms and conditions.  You are responsible for providing and maintaining mobile devices, tablets, computers, or any device you wish to access internet or mobile banking with.  It is your responsibility to maintain proper updates and security on your devices to ensure proper operation.  Some older mobile devices and tablets may not be supported by FBT’s mobile app.  In the event the device is not supported, then the customer will have access to the website via a web browser.  Your continued use of the website or mobile / internet banking will constitute acceptance of the terms and conditions.   

Inactivity, Failed Log in Attempts, Termination of an Account, or Requested Closure of an account.

Inactivity of an account will result in locked account.  If you have not logged on in 30 days the account will become dormant.  The customer must call FBT Internet and Mobile Banking team to reinstate the account.  Three failed log in attempts will result in the account being locked out.  The customer must call FBT Internet and Mobile banking team to unlock the account.  If FBT finds violations to laws of your Mobile or Internet banking account we may suspend or terminate your account.  It is your responsibility to contact the Mobile or Internet banking team to close your account.

Security

If you believe your user credentials have been lost or stolen please contact FBT at 870-352-3107 between 9:00 a.m. and 4:00 p.m. Monday through Friday for assistance with password change.  If you believe a fraudulent transaction has taken place on your account please contact FBT Bank immediately.  At your discretion you will need to review and change your password every 90 days.  You will be responsible for protecting your user credentials.  You should make every effort to utilize proper virus, malware, or firewall protection on your Computers or Mobile devices.  You should review signs of fraudulent activity, social engineering attempts, or attacks against your personal hardware.  FBT Bank and Mortgage will not be responsible for personal hardware and reserves the right to direct to a repair facility if we deem the problem outside of our control.

Account Alerts

You have the option to set up email or text alerts keeping you updated in real time on transactions or changes to your account.  It is recommended that you review these options as a security measure.  Being proactive on your account status is the best way to ensure you are not being harmed or fraudulent activity is not taking place.  Alerts will provide you with information such as password, email, or account changes.  Account alerts also provide you with notification of transactions, transfers, or other important account activity.  These alerts will need to be reviewed and activated by you.  FBT bank can assist with this setup.  The following methods of delivery including text and email are utilized for these notices.  You should review possible internet or cell charges that are associated with bandwidth or other carrier limitations.  FBT Bank is not responsible for carrier fees.  Your continued use of the website or mobile / internet banking will constitute acceptance of the terms and conditions.

FBT Bank and Mortgage may establish links between its website and one or more websites operated by third parties. FBT Bank and Mortgage has no control over the content or products/services of such websites. The existence of such third party linked websites shall not constitute an endorsement, representation or warranty by FBT Bank and Mortgage of the contents, products/services or operators of such websites. FBT Bank and Mortgage will make every effort to notify you of an external website link that is related to us.  However some third party links may provide paths to sites that are not controlled by FBT Bank and Mortgage. It is the user’s responsibility to determine when a third party site is accessed and if they should continue use of that website.

You agree that you will not utilize content from this website without proper permissions.  If permissions are given you agree not to delete or modify copyright, trademark, or other contents from the website. 

No Warranties

FBT Bank provides the content of its Website and Internet or Mobile banking “as is”.  FBT attempts to provide accurate information and content on its website but cannot be held accountable for incorrect content.  Use of this website by the user is an agreement that use is at the user’s sole risk.  FBT Bank and Mortgage also makes no representations, endorsements or warranties, either express or implied, with respect to any website operated by a third party. 

Limitation of Liability

In no event shall FBT Bank and Mortgage, nor any of its officers, directors, employees, or contractors be held liable for anything arising out of or in any way connected with your use of this Website whether such liability is under contract.  FBT Bank and Mortgage, including its officers, directors, employees, and contractors shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

Indemnification

You hereby indemnify to the fullest extent FBT Bank and Mortgage from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms. 

Variation of Terms

FBT Bank and Mortgage is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.  Your continued use of the website or mobile / internet banking will constitute acceptance of the terms and conditions. 

Governing Law & Jurisdiction and Wavier of Trial by Jury

These Terms will be governed by and interpreted in accordance with the laws of the State of Arkansas, and you submit to the non-exclusive jurisdiction of the state and federal courts located in the United States of America for the resolution of any disputes.

You hereby intentionally, voluntarily and knowingly waiver any and all rights to have a trial by jury with respect to any action brought based upon this Agreement.
